1. Overview

These Terms of Service (“Terms”) govern your access to and use of the website www.brightgreenroofcalgary.ca (the “Site”) and any services provided by Bright Green Roof Calgary (“Bright Green Roof Calgary,” “we,” “us,” or “our”). By using the Site, requesting a quote, booking an inspection, or engaging our services, you agree to these Terms.

Bright Green Roof Calgary provides roof maintenance and shingle-preservation services in Calgary, Alberta. Contact details appear in Section 17.

3. Quotes, Estimates & Bookings

• Estimates: Any price or timeline provided prior to inspection is a non-binding estimate based on the information available. Final pricing is confirmed after on-site assessment.
• Inspection & Eligibility: Services proceed only if your roof passes a health/eligibility check (e.g., shingle condition, structural suitability, safety access).
• Scheduling: Dates are subject to weather and safety conditions. We may adjust appointment times with reasonable notice.
• Change Orders: If conditions on site differ from what was disclosed or expected, we may issue a revised scope and price for your approval before proceeding.

4. Payment Terms

• Due Dates: Unless otherwise stated on your invoice or service agreement, payment is due upon completion of services.
• Methods: We may accept cash, card, e-transfer, or other approved methods listed on the invoice.
• Taxes: Applicable taxes are additional and will be itemized on your invoice.
• Late/Non-Payment: Overdue balances may accrue late fees or interest as permitted by law. You agree to reimburse reasonable costs of collection.

5. Customer Responsibilities

• Provide accurate information about your property.
• Ensure safe access to the roof and relevant areas (e.g., clear driveway, remove obstacles, secure pets).
• Inform us of known hazards (e.g., electrical risks, structural issues) prior to service.

6. Service Scope & Results

• Our services are maintenance/preservation in nature and do not replace a full roof replacement where required.
• Performance results (e.g., appearance, longevity) depend on factors outside our control (age, prior damage, ventilation, weather, maintenance).
• Any photos, videos, or testimonials shown on the Site are illustrative and not guarantees of outcome.

7. Warranties & Disclaimers

• Workmanship/Product Warranties: Any written warranty terms will be provided in your invoice or service agreement. To the fullest extent permitted by law, all other warranties (express or implied) are disclaimed.
• No Professional Advice: Information on the Site is for general information only and is not technical, engineering, or legal advice.

8. Limitation of Liability

To the fullest extent permitted by law, Bright Green Roof Calgary and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from or related to the Site or services. Our total liability for any claim shall not exceed the amount you paid for the specific service giving rise to the claim.

The Site may link to third-party tools (e.g., scheduling, payments, analytics). We are not responsible for third-party content, policies, or practices.

10. Intellectual Property

All content on the Site (text, images, logos, graphics) is owned by or licensed to us and protected by law. You may not copy, modify, or distribute our content without prior written permission.

12. Privacy & Communications

• Privacy: Our collection and use of personal information is governed by our Privacy Policy.
• Email (CASL): By opting in to receive emails, you consent to receive service updates and marketing messages. You may unsubscribe at any time using the link in our emails or by contacting us.
• SMS/Text: If you opt in to SMS, you consent to receive messages related to appointments, service updates, and promotions. Message and data rates may apply. Message frequency varies. Text STOP to unsubscribe or HELP for assistance.

13. Cancellations & Rescheduling

• You may cancel or reschedule with reasonable notice (see your booking confirmation for any stated minimum notice period).
• Weather or safety conditions may require us to reschedule. We will provide prompt notice and a new date.

14. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including severe weather, accidents, labour issues, acts of God, or utility/internet outages.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site or services after changes constitutes acceptance of the updated Terms.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Alberta and applicable federal laws of Canada. You agree to the exclusive jurisdiction and venue of the courts located in Calgary, Alberta for any disputes not otherwise resolved between us.

18. Entire Agreement & Severability

These Terms, together with any written service agreement or invoice, constitute the entire agreement between you and us concerning the services. If any provision is held invalid, the remaining provisions remain in full force and effect.
